§ 5.32.060. Retail license prohibited in certain zones and areas.

  • A.

    No retail license shall be issued for a place of business located or to be located in a zone where such place of business is prohibited under the zoning ordinance of the city.

    B.

    No place of business where sale of cereal malt beverages is permitted for consumption on the premises may be located within the following described areas:

    1.

    Within two hundred feet of any church or school. Such distance shall be measured from the nearest property line of the church or school to the center of the nearest doorway serving as an entrance into the place of business.

    2.

    On any property under municipal ownership, provided that a license may be issued to a qualified licensee for sale of cereal malt beverage in the expo area of the Great Bend Municipal Airport at a location as approved by the governing body at the time a license is issued; and provided further, a license may be issued to a qualified licensee for sale of cereal malt beverage in the spectator area of Al Burns Baseball Field at Veterans Memorial Park.
