§ 5.32.100. Hours and days sales, consumption and possession prohibited.

  • A.

    No cereal malt beverage may be sold:

    1.

    Between the hours of 12:00 p.m. and 6:00 a.m. Monday through Saturday.

    2.

    On Sundays, except in a place of business which is licensed to sell cereal malt beverage for consumption on the premises and which derives not less than thirty percent of its gross receipts from the sale of food for consumption on a licensed premises and subject to the licensee complying with the conditions set forth in subsection B of this section.

    3.

    On Sundays, in original and unopened containers and not for consumption on the premises, before 12:00 noon and after 8:00 p.m.

    B.

    Sunday sales of cereal malt beverages shall be allowed pursuant to subsection (A) of this section if the general retailer has complied and is in compliance with the regulations as provided in subsection (A) or has submitted a certified statement signed by the owner of such business indicating proof that thirty percent of the total gross income is derived from the sale of food for consumption on the premises and containing a notarized statement signed by an independent public accountant or certified public accountant who has reviewed the books of such business indicating that he books of such business have been kept in a manner to provide proof that thirty percent of the total gross income is derived from food sales for consumption on the premises.
